Latrobe City Council endorsed by resolution the release of the Draft Governance Rules at the 3 July Ordinary Council Meeting, for a four-week community consultation period, pursuant to section 60(4) of the Local Government Act 2020 and Council’s Community Engagement Policy.
Under the Local Government Act 2020 (the Act), all Councils must adopt and maintain Governance Rules to prescribe the procedures governing the conduct of Council meetings and Delegated Committee meetings.
As a result of the introduction of new provisions into the Act, Council is required to review and update its Governance Rules, in consultation with the community, to include provisions relating to:
the conduct of council (and delegated committee) meetings held by electronic means; and
requesting and approving attendance by electronic means.
While making these changes, a wider review has been undertaken to incorporate additional changes to improve their clarity and function.
Some of the key changes include, but are not limited to:
Primary amendments – to support virtual meetings:
Rule 10 – provides for the Chief Executive Officer and/or Mayor to determine whether a meeting will be in a virtual or hybrid format.
Rule 11 – requirements for a Councillor to attend a meeting virtually.
Rule 12 – responsibilities of a Councillor attending a meeting virtually.
Rule 63 – provides for the community to participate in meetings in person or virtually.
Rule 69 – revised requirements for a person wishing to speak at a meeting either in person or virtually.
Additional amendments
Rule 9 – provides for the Chief Executive Officer, in consultation with the Mayor, to change the location of a meeting subject to public notice.
Rule 22 – changes the process for raising and dealing with Notices of Motion.
Rule 38 – changes to allow additional information to be included in a report deferred to a later meeting.
Rule 70 – revised process for dealing with public questions at a Council meeting.
